Terms of Service

1. Acceptance and eligibility

By using Fitness Assist, you agree to these Terms and the Privacy Policy. If you use the service for an organization, you confirm that you are authorized to act for it. If you do not agree, do not use the service and send STOP.

You must be able to enter into these Terms under applicable law. A minor may use the service only with all legally required parent or guardian consent and organization approval.

2. Service scope

Fitness Assist is a service operated through cosher-gufani.co.il.

Fitness Assist helps participants record meals, weight, physical activity, sleep, hydration, and healthy habits, observe trends, receive general wellness suggestions and encouragement, and optionally share selected statistics with an assigned trainer.

Features may change as the service develops. Audio and image processing may be added later and, when available, may require separate limits, notices, or confirmation steps.

3. Not medical or emergency advice

Fitness Assist provides general information and tracking support only. It is not a healthcare provider, medical device, dietitian, therapist, or emergency service. It does not diagnose conditions, prescribe treatment, or replace advice from a qualified professional.

Do not rely on the service for urgent or high-risk decisions. If you may be in danger or have a medical emergency, stop using the service and contact local emergency services. Food, calorie, image, audio, and weight interpretations may be incomplete or inaccurate and must be independently confirmed.

4. Trainer relationship

Trainers and organizations are independent from Fitness Assist unless expressly stated otherwise. Fitness Assist does not supervise their qualifications, services, recommendations, or conduct. A participant decides separately whether selected statistics may be visible to the assigned trainer and may revoke that choice with PRIVATE.

5. Accounts and acceptable use

You agree to use Fitness Assist only for lawful wellness-tracking purposes. You must not:

• Attempt to obtain another person's data or access another organization, trainer, or participant account.
• Submit illegal, abusive, deceptive, infringing, malicious, or dangerous content.
• Probe, disrupt, overload, reverse engineer, or bypass security, usage, or account controls.
• Use Fitness Assist as a general-purpose chatbot, automated scraping tool, or substitute for professional medical advice.
• Share access credentials, invite codes, or administrative keys with unauthorized people.

6. WhatsApp and third-party services

Use of Fitness Assist through WhatsApp also depends on Meta's and WhatsApp's terms, availability, and policies. Hosting, messaging, and optional processing providers may experience interruptions or change their services. We are not responsible for third-party services outside our reasonable control.

7. Fees

Organizations or trainers may purchase plans based on active participant seats and optional features. The price, limits, billing period, cancellation terms, and taxes are the terms shown in the applicable order or subscription. Participants are not charged by Fitness Assist unless a separate offer expressly states otherwise.

8. Suspension, opt-out, and termination

We may suspend or disable an organization, trainer, or participant to protect the service, enforce these Terms, respond to non-payment, or comply with law. Disabling is generally reversible. A participant may send STOP to opt out and DELETE to request permanent deletion of participant data as explained in the Data Deletion Instructions.

9. Intellectual property

Fitness Assist and its software, branding, documentation, and original content are protected by applicable intellectual-property laws. You retain rights in content you submit and grant us the limited permission needed to process it and provide, secure, and improve the service in accordance with the Privacy Policy.

10. Availability and disclaimers

The service is provided on an as-available basis. We work to keep it reliable and useful, but do not promise uninterrupted availability, error-free output, a particular wellness result, or that automated suggestions will always be accurate. Nothing in these Terms excludes rights or obligations that cannot lawfully be excluded.

11. Liability

To the maximum extent permitted by applicable law, Fitness Assist is not liable for indirect, incidental, special, or consequential loss arising from use of the service. Any limitation applies only where lawful and does not limit liability that cannot legally be limited.

12. Changes and contact

We may update these Terms as the service changes. Material updates will be communicated through an appropriate channel. Continued use after an update takes effect means you accept the revised Terms, except where applicable law requires another form of consent.
